Wedding Contract Agreement
ENTIRE AGREEMENT
This agreement contains the entire understanding between BRANDI GRAHAM PHOTOGRAPHY and the Client. Any changes to the terms and conditions detailed within this contract must be set out and agreed by both parties in writing. This agreement shall be governed in accordance with the laws of USA.
DEPOSIT AND PAYMENT
Client shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable reservation retainer equal to 25% of chosen package. No date is reserved until the contract and retainer are received. The remaining balance due for the photography services must be paid in full 1 week before the wedding day. The Photographer is not responsible for the rendering of services until the full balance is paid.
LATE PAYMENT
In the event Client fails to remit payment as specified, the BRANDI GRAHAM PHOTOGRAPHY shall have the right to immediately terminate this Agreement with no further obligation, retain any monies already paid, and not attend this event. Unless the contract is canceled, the retainer fee shall be applied to the photography fee total. All late payments will be assessed a $100 per week fee.
CANCELLATION
If for any reason the Client cancels before the wedding date, the Photographer will keep the the event retainer fee paid to hold the wedding or event date as a cancellation fee. Cancellation must be made in sent in writing, by mail or e-mail. However, if the client requires to change the wedding date, BRANDI GRAHAM PHOTOGRAPHY will do the best to accommodate the change and no fee will be charged as long as the new date is available and within five months of the original event date. If BRANDI GRAHAM PHOTOGRAPHY is not available for the new date, the original contract will be cancelled and subject to the cancellation policy.
If BRANDI GRAHAM PHOTOGRAPHY cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the retainer fee to the Client but shall have no further liability with respect to the Contract.
WEDDING DETAILS:
A timeline of the wedding day, including dates, times and locations will be agreed in writing beforehand to ensure the photographer has an agreed plan for services required. Any changes to these arrangements by either the Client or the photographer shall need to be agreed in writing.
VENUE RESTRICTIONS:
Photographer may be necessarily limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. Client understands and agrees that Photographer will abide by such guidelines or rules and that they are outside the control of Photographer. Client agrees to hold Photographer harmless for the impact such guidelines or rules may have on the resulting photographs.
CREATIVE CONTROL:
The Client agrees to give the photographer creative freedom when it comes to editing and retouching images, with any specific requirements made in writing by the Client prior to the agreed wedding date. By signing this contract, the client is aware of the style of photography that BRANDI GRAHAM PHOTOGRAPHY produces.
COPYRIGHT:
The Photographer retains the rights to all images produced as part of his photography services offering. Unless otherwise stated in writing the images produced will be granted the Client with an “All Purpose, All Media” usage license which means they are free to use the images in any way desired for as long as desired and places no restrictions upon their personal usage.
PROMOTIONAL USAGE:
The Client hereby allows the photographer to use any image produced for promotional purposes, including but not limited to website advertising, social media, brochures, magazine articles, sample albums etc. The photographer cannot be held liable or accountable for malicious actions using these images by persons other than BRANDI GRAHAM PHOTOGRAPHY employees.
REFUND POLICY:
Our commitment is to delivering quality and satisfactory service and/or products. In case Client is not completely satisfied with our products we would do our best to resolve the issues to the best of our abilities. Please contact us via email or phone call explaining the specific areas of concern.There will not be any refund for the Services already rendered in accordance with the service contract issued to you at the time of booking. Booking advances are non-refundable under any circumstances.
If the Client chooses to not take any deliverables agreed upon at the time of booking after the shoot is over, there will not be any refunds in any form (for instance, printed albums, videos, teasers etc.) Any changes in the deliverables have to be informed to us in writing at least 30 days in advance from the first date of the shoot.
LIMITATION OF LIABILITY:
In the unlikely event that the Photographer are unable to perform to the guidelines of this contract due to injury, illness, act of God, or other cause beyond the control of the Photographer, the Photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement can not be found, responsibility and liability is limited to the return of all payments received for the EVENT(S).
OVERTIME:
BRANDI GRAHAM PHOTOGRAPHY charges $300/hour for each overtime hour. Overtime rate is subject to change and may not be the same once your wedding day arrives. All overtime will be booked to client after the event and no images will be delivered until it is paid.
SECOND SHOOTER:
If a second shooter is selected for the event and added to the contract please be advised that they will be there for the hours chosen by the photographer. Second shooters may not be there for the entire day depending on the needs of the photographer that day. Clients must give discretion to BRANDI GRAHAM PHOTOGRAPHY on this matter.
DELIVERY OF IMAGES:
BRANDI GRAHAM PHOTOGRAPHY will deliver the agreed upon high-resolution images on a personalized USB stick, and the images will also be available to view and download from a private online gallery (that can also be password protected if desired) gallery on within approximately 8-10 weeks after the wedding. Once the images have been delivered, the Client accepts all responsibility for archiving and protecting the digital files.
IMAGE PROCESSING:
The digital editing process can only start post the main wedding event. Digital processing takes approximately 8-10 weeks. All images will be adjusted for exposure, brightness, contrast, sharpness, etc. with photographers judgement regarding these corrections shall be deemed correct.The photographer will deliver high resolution (300DPI) images. BRANDI GRAHAM PHOTOGRAPHY will not give out RAW or/and unedited images.
MEALS:
A meal must be provided by Client for Photographer and those employed by photographer for events 4 hours or longer. BRANDI GRAHAM PHOTOGRAPHY is responsible to inform the clients of any second shooters or assistants prior to the date of the wedding so extra meals can be set aside. If a meal is not provided BRANDI GRAHAM PHOTOGRAPHY reserves the right to leave for one hour to travel to get a meal.
Terms & Conditions
This contract is written for the purpose of personal portraits. The signing of this contract states the client understands that it is their choice to participate in these photos. The client understands that they will decide whether or not these images are made public, and will make studio aware of these preferences. The client is agreeable to the terms, conditions, and timeline of the session, and the delivery of images and products. The client states that they are 18 years or older. If the client is not 18 years or older, they understand a parent or legal guardian is required to sign this contract as well. Any addendums made to this contract, must be agreed upon by all parties involved, in writing.
Client Usage Rights/Copyrights: The photographs produced by studio are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without studio explicit written permission. It is a breach of this contract to reproduce the images in any form unless rights were purchased within the package for those images.
Client reserves the right to post images on social networking sites such as Facebook and Twitter. It is a breach of this contract to crop/hide studio logo.
Turn-around time frame for delivery of final images is 1-2 weeks.
There will be limited copyright ownership of digital images delivered under these conditions:
Commercial use of these photos is prohibited. These images are for personal use only, and may be reproduced for the purpose of sharing with friends and family. Images may not be altered or changed, other than resizing. Watermarks may not be removed if present. In the event that these photos will be published, sold for profit, used within marketing materials or promo websites the client must obtain written permission from and compensate studio prior to the release. Additional contract will be needed at that time.
Studio Usage Rights/Copyrights: Studio reserves the right to use and publish photographs in any manner or medium. Client grants studio permission to use images taken within this session in sample albums, marketing materials, editorial, online web presences, including but not limited to, website, social networks, blog, etc.
Payment Stipulations: There is a $30 fee for any returned checks. In the event of a previous returned check by client, studio reserves the right to refuse payment of checks in the future, in which case cash, money order, cashier’s check, and debit/credit will be accepted.
Disclaimer: Prices are subject to change at any time without client notification. This contract solidifies the package contents and price at the time of booking.
Additional Fees: Additional fees may be assessed for the adding of more than the allotted number of subjects within this portrait session. In the event that the client specifies a certain location to be used during the shoot, the client is responsible for all location fees involved such as location access fees, parking, etc. Client is also responsible for arranging the location access and any permits/passes related to doing so.
Reshoot Policy: In the event that studio is required by the client to reshoot the session without 7 days prior notice, the client will be responsible for an additional retainer deposit of $50 to secure that date. In the event that the weather conditions or initial locations are not available or desirable for the shoot based on studio recommendations, the session will need to be rescheduled (outdoor locations).
Limit of Liability: In the unlikely event that the photographer is injured or becomes too ill to photograph the session, a reshoot will be scheduled for the next available time slot. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond studio control, studio liability is limited to the return of all payments received for the portrait session. The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals.
Client agrees not to hold Photographer or owner of session location liable for any injury, damage or other caused by the Photographer or equipment during the session. All efforts will be made to ensure a safe environment and care will be taken to preserve the integrity of your belongings.
